New report on migrants’ detention - November 2010FRA, the Fundamental Rights Agency, just issued a new report on migrants’ detention in return procedures that examines six principal questions : the grounds for detention; the principles of necessity and proportionality; maximum length of detention; procedural safeguards to prevent arbitrary detention; alternatives to detention; and detention of children. FRA reminds, between others, that grounds for pre-removal detention should be clearly specify in national legislation and that exercise of the right to judicial review of the detention order should be made possible in practice.
